Item to Keep in Mind: Be aware of the Federal Estate Tax Repeal Law – it is more complicated than you think. The Federal Estate Tax has been repealed for only the 2010 tax year. This temporary repeal of the estate tax is a result of the passage of the Economic Growth and Tax Relief Reconciliation Act (EGTRRA), which repeals the Federal Estate Tax until January 1, 2011 during which time this tax is scheduled to be reinstated. As a result of this development, your estate planning documents may be misinterpreted. For example, provisions in your Will could leave your spouse or other members of the family “out in the cold.” In other words, they may not receive anything from your estate as a result of this tax law change. Certain terms such as “marital deduction” and “estate tax exemption amount” are not applicable in the law for 2010. We may proceed to revise your Will in order to avoid unintended consequences to your family. Contact me to discuss this further should this repeal have an affect on your estate plan.
